I have a similar timeline - applied for LC in February 2002, got approval in December 2003, filed I-140 in February 2004, I-485 in March 2004. Currently filing for my fifth EAD! The USCIS not only tortures the whole family (it's a common practice that name check is pending only for primary applicant) but makes us to pay for the wait! My son was born around the time we filed for adjustment of status, he will go to school soon but we are still not sure whether we will be allowed to stay. We cannot plan ahead and open education funds for our children. My wife cannot go to college, as she is not eligible for in-state tuition discount. Needless to say, I am forced to sacrifice my career as the whole thing is dragging for 5+ years and I have to work at the same position to keep GC process alive. I've got MCSD certificate and outgrew my position long ago. I cannot quit my job and found a new business.

EB1 was applied under the Extraordinary ability. I also have a EB2-NIW I-140 cleared as well. Hope that answers your question.
As far as I know employer sponsorship is not required for EB-1 EA case; not sure why you had to file I-140 for this ...........

How about working on an EAD in a part-time job while working full-time on your h1 sponsored job? I assume the h1 will not become invalid in this case because EAD is being used for the part time job.

Last week I visited the cutter Dallas in a shipyard in Charleston. The Dallas, and her sister ship Gallatin, are undergoing extensive work to repair major structural and machinery problems that are the result of their age and overuse. The national security cutter program will replace these 40-year old, Vietnam era vessels with modern, capable ships to secure America.
In Wednesday's seizure off the coast of Guatemala, the crew of the Bertholf disrupted four drug smuggling speedboats at the same time with their multiple pursuit boats and helicopter. The crew successfully captured two vessels and four suspects while disrupting the other two boats.
The continued renewal of the Coast Guard fleet and use of modern technology across the department is an indispensable part of our strategy to improve the ability of DHS to secure our nation and protect its citizens.

Hi,
I am going to get married next week.
I am a H-1b visa holder and I have applied for green card. I am waiting to get approval of I-140.
I want to file the H-4 visa for my wife and I have couple questions :
1) How difficult is to apply for H-4 ? Do I need a lawyer for that ?
2) How will my new status effect my green card application ? Do I need to apply again for I-140 ?

I too got the soft lud's on May 21 for all of my 485. There is no change in the current status. Could that be FPs are sent or just a regular batch update? I don't know.

to be frank with you guys my friend have a good bank statment and business in his own country he wanna apply for a tourist visa and i recomended for him to have a hotels .... flight reservation but i am still confused about the purpose of the visit actually its not about the purpose its about his chance to get a visa he never been in the US never apply for a visa , dont have any relatives in the US he wanna try his chances to get a visa only ?????

Is letter from employee needed for filing I-485 for my spouse. I filed I-485 under EB3 last August and it's still pending. She takes my PD and my PD will be current in May. I have an old letter from my employer when filing my I-485 last August but was wondering if a new letter from employer is needed or the old one would do.

I forgot to mention one thing..my h1 was done by an university ...in 2002 when this quota was not there....just because its done by an university..I cannot assume it came under a non quota-exempt...since this was done when the quota system was not in existence...

Thanks for taking time to answer my query. I have other problem so I am confused about this fact. My spouse's name is correct on passport. but her mother's surname has spelling mistake.All other details are correct. We were not aware of the fact till now. Now we are in the process of applying for I485.
So I am worried about all this. If I take affidavit, it will work?

1) Can my spouses H1b get 7th year extension based on this?
I actually did get a H-1B extension once based on the fact that the spouse (also H-1B) had an approved I-140 priority date that was backlogged. It was an unusual approval, and surprised the other attorneys (including partners) where I was working. It's not guaranteed, but worth a try if there is no other option to work.

1 st employer: Worked as a Programmer Analyst for 6 months
2nd employer: Worked as Sr.Software Engineer for1.6 years
3rd Employer: Worked as Sr.Software Engineer for 2 years
Under unexpected circumstances, 2nd employer filed my H1 for a senior level even when I have only 2.5 yrs of experience.
I am trying to change job and look for a prospective employer who would file my labor/GC immediately.
The 4rth employer is willing to my GC but the Job designation will be Software Engineer.
Can you please advise if there would be any negative impact on my GC process if I take a step down in my title.
I liked the organization, work environment and all I am concerned now is about any RFC's for the different Job Titles I had so far.
I am in a very confused state and Please advise me as I need to respond for the Job offer.
I sincerely appreciate your help.
